Terms of Service

By accessing, browsing, or using AIKit ("the Service"), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, you must discontinue use of the Service immediately. We reserve the right to modify these terms at any time, and your continued use of the Service constitutes acceptance of any modifications.

AIKit provides a comprehensive suite of digital tools and AI-powered services, including but not limited to:

• •Browser-based tools: image editing, PDF manipulation, audio recording, video editing, color tools, developer utilities, and text processing.
• •AI-powered features: AI companion chat, text generation, resume builder, music generation (SoundKit), and content creation.
• •Media processing: file conversion (audio, video, image, document), background removal, OCR text extraction, and speech-to-text transcription.
• •StudioKit: AI-powered photo and video generation platform accessible via cross-app authentication.

We may update, modify, add, or remove tools and features at any time without prior notice. Free tools may become paid, and paid tools may change pricing.

To access certain features, you must create an account. You agree to provide accurate, current, and complete information during registration. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account. We reserve the right to suspend or terminate accounts that violate these terms or exhibit suspicious activity.

AIKit operates on a credit-based system. Free accounts receive a limited allocation of credits. Additional credits can be purchased through:

• •Stripe — standard credit/debit card payment processing.

All credit purchases are final and non-refundable unless required by applicable law. Credits have no cash value and cannot be transferred between accounts. Unused credits from free plan grants do not roll over. Pro plan credits reset monthly.

To ensure fair access for all users, we enforce usage limits based on your plan tier. Browser-based tools are generally unlimited. API-based and AI-powered tools are subject to daily, monthly, or lifetime usage limits and credit costs. You agree not to:

• •Use the Service for any illegal, harmful, or unauthorized purpose.
• •Attempt to circumvent usage limits, rate limits, or access controls.
• •Upload or process content that is illegal, infringing, or violates third-party rights.
• •Use automated scripts, bots, or scrapers to access the Service without authorization.
• •Reverse engineer, decompile, or attempt to extract the source code of the Service.
• •Resell, redistribute, or commercially exploit the Service without written permission.

The AIKit platform, including its design, code, features, branding, and documentation, is the intellectual property of SAM Media B.V. and is protected by applicable copyright and trademark laws. Content you create using our tools belongs to you, subject to the terms of any third-party AI models used in generation. You grant us no rights over your content beyond what is necessary to provide the Service.

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using the Service, you consent to the data practices described in our Privacy Policy.

We reserve the right to suspend or terminate your access to the Service at any time, with or without cause and with or without notice, including for violation of these Terms. Upon termination, your right to use the Service ceases immediately. Any unused credits will be forfeited. You may also delete your account at any time through your dashboard settings.

The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied. To the maximum extent permitted by applicable law, SAM Media B.V. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or business interruption, arising from your use of or inability to use the Service. Our total liability shall not exceed the amount you have paid us in the 12 months preceding the claim.

These Terms shall be governed by and construed in accordance with the laws of the Netherlands. Any disputes arising from these Terms or the Service shall be resolved through binding arbitration or in the competent courts of Amsterdam, the Netherlands. You agree to submit to the personal jurisdiction of such courts.
